HDA vs Non-HDA Property
HDA can prescribe SPA forms, payment stages, completion obligations, defect liability and housing-development accounts. Non-HDA buyers need deeper contract and developer-risk review.
What is the difference between HDA and non-HDA projects?
An HDA sale falls within Malaysia’s housing-development statutory framework and prescribed protections, while a non-HDA transaction depends more heavily on its bespoke contract and general law. A commercial label alone does not conclusively answer whether HDA applies.
What buyers should know
Five key points.
- 01
Confirm HDA coverage from the developer licence, advertising permit and SPA—not assumptions.
- 02
Non-HDA contracts may have different payment, termination and delay clauses.
- 03
HDA does not guarantee completion or investment performance.
- 04
Some serviced residences can be sold under HDA despite commercial land/title features.
- 05
Legal review is essential before paying non-refundable sums.
Practical example
Two serviced apartments may both have commercial titles, but one may use a prescribed HDA SPA while the other uses a bespoke commercial agreement.
Examples are simplified for education and do not replace an assessment of the actual purchaser, title, SPA, financing or tax position.
Before committing
